Subscription Terms

Acceptance

These Subscription Terms are the contract between you and Mobize Tecnologia e Inovação LTDA, Brazilian company number (CNPJ) 29.414.800/0001-30, registered office at Avenida Francisco Galassi, 1404, Sala 104 Parte B, Bairro Patrimônio, Uberlândia/MG, 38411-108, Brazil, which operates the platform under the Take Sales brand. By creating an account, subscribing to a plan or using the platform, you agree to them. If you accept on behalf of a company, you confirm you have authority to bind it.

Simply browsing takesales.ai is governed by the Website Terms of Use.

What the service is

Take Sales is a software-as-a-service platform for building, configuring and running AI voice and text agents, connecting them to your site and support channels, and reviewing the resulting conversations. What each plan includes is described on the pricing page.

Your account

• You must be 18 or older and give accurate information when signing up.
• You are responsible for keeping your password secret and for all activity under your account.
• Tell us immediately at support@takesales.ai if you suspect unauthorised access.

Plans, billing and cancellation

• The prices and limits that apply are the ones published on the pricing page when you subscribe.
• Subscriptions are billed on a recurring basis and renew automatically until you cancel.
• You can cancel at any time from the dashboard; it takes effect at the end of the period already paid for, with no pro-rata refund of a started period except where consumer law requires one.
• Usage above your plan limit (voice minutes, conversations or integrations) is billed at the rates then in force.

Acceptable use

You may not use the platform to:

• Send spam or unsolicited bulk messages, or breach the rules of the connected channels or applicable telemarketing law.
• Present the agent as a human being where the law or the channel requires disclosure that it is an AI.
• Process sensitive data (health, biometrics, children’s data) without a legal basis and without configuring the platform for it.
• Circumvent technical limits, reverse-engineer the models, or use the service to build a competing product.
• Publish, or induce the agent to produce, unlawful or defamatory content or content that infringes third-party rights.

Breaching this section can lead to immediate suspension of access, with prior notice wherever that is possible.

Your content and your data

Everything you upload (knowledge base, instructions, transcripts, recordings) stays yours. You grant us only the licence needed to host, process and display that content while the service is active. We do not use customer content to train AI models.

In the conversations your agents hold with your audience, you are the data controller and Take Sales is the processor, under the LGPD and the Privacy Policy.

The limits of AI

AI agents get things wrong. Replies are generated by language models and can be inaccurate, out of date or invented, even with the guardrails the platform applies. It is on you to review your agent’s configuration, define what it may assert, and keep escalation to a human for subjects where a mistake is costly. Take Sales does not warrant the factual accuracy of any generated reply and is not liable for decisions taken on the basis of one.

Availability

We work to keep the service continuously available, but it can be interrupted by scheduled maintenance, vendor failure or events outside our control. Formal availability commitments, where they exist, are set out in the contract for the plan you subscribed to.

Suspension and termination

• You can close your account at any time from the dashboard.
• We may suspend or terminate access for breach of these terms, non-payment, or risk to platform security.
• After termination your data stays available for export for 30 days and is then deleted, except what the law requires us to keep.

Limitation of liability

To the fullest extent the law allows, Take Sales’ total liability for any claim relating to the service is limited to the amount you paid in the 12 months before the event giving rise to the claim. We are not liable for lost profits, lost business opportunity or indirect damages. Nothing here excludes rights that Brazilian law does not allow to be excluded.

Changes to these terms

We may change these terms. Material changes are announced by email at least 30 days in advance. Continuing to use the service after they take effect means accepting the new version.

Governing law and jurisdiction

These terms are governed by Brazilian law. The courts of Uberlândia/MG have exclusive jurisdiction over disputes arising from them.
